Right of Withdrawal

The information below is provided under Articles 6(1)(h) and 9–14 of Directive 2011/83/EU on consumer rights, as transposed into Cypriot law. It applies to consumer purchases of goods from the NextBaller storefront operated by M-Sport Equipment Ltd.

1. Your right to withdraw

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods. Where the order comprises multiple goods delivered separately, the period runs from the day of acquisition of the last item.

2. How to exercise the right

To exercise the right of withdrawal, you must inform us of your decision by means of an unequivocal statement (for example, a letter sent by post or e-mail). You may use the model form set out in section 5 below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

3. Effects of withdrawal

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of standard delivery (with the exception of supplementary costs arising if you chose a type of delivery other than the least expensive type offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods unless the item is faulty or not as described.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

4. Exceptions

Under Article 16 of Directive 2011/83/EU, the right of withdrawal does not apply to:

  • Goods made to the consumer's specifications or clearly personalised (for example, items printed with a player's name and number).
  • Sealed goods which are not suitable for return due to health-protection or hygiene reasons and which were unsealed after delivery.
  • Supply of digital content not provided on a tangible medium, where performance has begun with the consumer's prior express consent and the consumer's express acknowledgement of the consequent loss of the right of withdrawal (Article 16(m)). 6. Complaints and dispute resolution

Complaints should be addressed to the contact above in the first instance. If we are unable to resolve a dispute with you, you may refer the matter to the Cyprus Consumer Protection Service, or use the European Commission's Online Dispute Resolution platform under Regulation (EU) 524/2013.

7. Legal guarantee of conformity

Independently of the right of withdrawal, goods sold to consumers carry a minimum two-year legal guarantee of conformity under Directive (EU) 2019/771. You may request a repair, replacement, price reduction or termination of the contract if the goods are not in conformity with the sales contract. This statutory guarantee applies in addition to any commercial warranty.
